Jacob A. With
Jacob graduated in the top 5% of his class from Baylor University School of Law. He joined our firm in 2008 and has engaged in an extensive civil litigation and real estate practice. His civil litigation and real estate practice involves a broad spectrum of legal representation from real estate transactions, to easement and title disputes, foreclosures and construction defect litigation.
In addition to civil litigation and real estate, Jacob has become a prominent estate planning, elder law, and probate attorney. He enjoys providing estate planning and elder law assistance to the Gunnison community, and has delivered numerous presentations throughout the Gunnison Valley regarding estate planning and elder law, including matters such as Medicaid planning and planning for incapacity.

Representative Matters
Representative Real Estate Matters:
Assisted clients with the purchase and sale of real estate, including easements;
Foreclosed on numerous properties, including commercial and residential, and successfully obtained and assisted with collecting on deficiency judgments;
Assisted multiple clients with successfully bidding on and acquiring real property through foreclosure;
Assisted junior lien holders with protecting their interests in real estate through the foreclosure process;
Assisted lenders with drafting loan documentation for real property, including deeds of trust, promissory notes, and other closing documentation;
Assisted out-of-state lenders with new loans secured by real property in Colorado, amending existing loan documents, and foreclosing on Colorado real property;
Represents numerous homeowners associations throughout Gunnison County. Represented homeowners' associations with the enforcement of assessment liens, collection of assessment liens, and protection of assessment liens in the foreclosure process; Represented homeowners' associations and developers with drafting, implementing and amending covenants and other documents governing homeowner's associations;
Successfully represented clients in disputes involving easements, including representation of plaintiffs in obtaining easements and defending against claims of easements;
Represented clients in mechanic's lien litigation, including successfully enforcing mechanic's liens;
Represented clients defending against mechanic's lien claims, and obtained satisfactory settlement of mechanic's liens;
Successfully protected clients' property rights in contested litigation against trespassers;
Successfully quieted title to real property;
Assisted clients with drafting and enforcing leases; and
Successfully contested Gunnison County Assessor valuations on real property.
Representative Estate Planning and Probate Matters:
Advised numerous clients in all aspects of estate planning, including drafting wills and trust agreements and written directives for the disposition of last remains;
Advised numerous personal representatives and trustees with respect to their fiduciary obligations and trust and estate administration;
Provided representation to personal representatives and trustees involved with contested estates and trusts, including representation in contested litigation; and
Provided assistance to numerous out-of-state personal representatives with the transfer of Colorado real property in what is referred to as an ancillary administration.
Representative Elder Law Matters:
Advised clients on Medicaid planning, including the availability of Medicaid and necessary financial planning to ensure financial eligibility;
Advised clients on planning for future disability, including the use of general powers of attorney, medical powers of attorney, living wills, appointment of guardians, appointment of conservators; and
Represented guardians and conservators with respect to establishing guardianships and conservatorships and also administering and ultimately closing the guardianships and conservatorships.
